Fundamental Terms
Da'Villas is a company offering a range of accommodations, including villas, bungalows, farmhouses, home stays, serviced apartments, boutique resorts, and individual rooms, all under the brand name “Da’Villas.” The following Terms and Conditions apply to all guests or customers who make bookings for any of these properties or their rooms through our website, mobile app, third-party websites, third-party apps, travel agents, or other booking channels (collectively referred to as “Booking Channels”).
Guests must review and understand these Terms and Conditions before using our website or booking through any channel. If you disagree with them, please do not use the site or make a booking.
Da'Villas may update these Terms and Conditions and related information at any time without prior notice. Changes take effect immediately upon posting. We may also alter services without notice. Continued use of the website or Booking Channels signifies acceptance of updated terms.
Unless specified otherwise, these Terms and Conditions override any previous agreements or understandings and take precedence over any conflicting terms from orders or services provided by Da'Villas.
For both online and offline bookings through our platform, the terms defined in these Terms and Conditions have the following meanings:
(a) “Property/Properties” encompasses villas, bungalows, farmhouses, home stays, boutique resorts, serviced apartments, and their individual rooms that can be booked through any Booking Channel.
(b) “Guest/Guests” identifies individuals, companies, or other entities who wish to book any of the Properties via any Booking Channel. The term may also be used as “you” or “your” in this context.
(c) “Booking” refers to the act of reserving accommodation at one of the Properties.
(d) “Check-In” denotes the scheduled date and time by which Guests must complete all check-in procedures required by Da’Villas to begin their stay at the property.
(e) “Check-Out” signifies the designated date and time by which Guests must leave the property after fulfilling all check-out requirements set by Da’Villas.
(f) “Booking Period” is the timeframe from the start of Check-In to the end of Check-Out.
(g) “Booking Amount” is the total payment required from the Guest to confirm the Booking. It must be made using the payment method specified by Da’Villas.
(h) “Da’Villas sends a “Booking Confirmation” to guests after receiving the advance payment. This document includes details such as the Booking, Terms & Conditions, guest names and numbers, Check-In and Check-Out times, property name, room count, Booking Amount, Security Deposit, and payment due dates. Full payment is required for confirmation. Guests must show the Booking Confirmation and proof of payment at Check-In.
(i) “Advance” is a non-refundable sum required to temporarily hold a Booking for a Property.
(j) “Security Deposit” is a deposit, which varies by case, required to cover potential damages to the Property or its contents and any additional charges.
(k) “Peak Days” refers to high-demand periods, such as long weekends and major holidays like Diwali, New Year’s, and Christmas.
Eligibility
Access to our Booking Channels for making reservations for a Property is restricted to individuals who are legally capable of entering into binding contracts as per the Indian Contract Act, 1872. Individuals deemed 'incompetent to contract' under this Act are not permitted to use our Booking Channels to make a reservation.
Da'Villas' Discretion in Providing Services
Da'Villas operates both online and offline platforms for booking Properties at competitive rates. Additionally, Da'Villas provides information about the Properties. However, the presence of specific amenities or services at the Properties at any given time does not guarantee their availability at all times, as Da'Villas reserves the right to modify or remove these amenities or services as needed.
Accept and Authorize
By using the Da'Villas website and its services, you agree to the Terms and Conditions of Use, Privacy Policy, and other related policies. These terms form a binding agreement, and by accessing or using the site, including making a booking, you confirm that you have read, understood, and accept them. The website and its reservation services are for personal, noncommercial use only.
Supplementary Services
Da'Villas may offer additional services like a chef, cleaners, or vehicle hire through thirdparty vendors upon request and subject to availability. These services are not included in the booking amount, advance, or security deposit and may incur extra charges. They are provided solely for guest convenience, with no obligation on Da'Villas' part.
Tariffs
Tariffs on Da’Villas channels are fixed, non-negotiable, and may change without notice. Rates are per room or multiple rooms and may not include taxes. Da’Villas may correct any errors in displayed tariffs, which are not binding.
Admission and Property Access Rights
Guests acknowledge they have no claim to possession or control over the Properties. Failure to meet check-in requirements will result in forfeiture of the Booking Amount/Deposit, with no refunds or compensation.
(a) Guests must present the Booking Confirmation issued by Da’Villas along with proof of payment for the full Booking Amount.
(b) In accordance with government security regulations, Guests must provide original government-issued photo IDs and copies of these IDs before check-in.
(c) Guests must record their name, address, and other relevant details, including those of children, in the Guest Register at the Property, whether physical or digital.
(d) Guests under 18 years of age must be accompanied by at least one adult.
If any Guest provides incorrect or false information at the time of booking, Da’Villas reserves the right to cancel the Booking immediately and deny entry to the Property. If the Guest is already checked in, they may be evicted by Da’Villas representatives. In such cases, the Booking Amount/Deposit will not be refunded, and no compensation will be provided. During check-in or throughout the stay, the total number of Guests and their visitors must not exceed the number specified at the time of booking. Da’Villas may allow additional persons to stay at the Property at its discretion and for an extra fee. Additional guests will only be permitted with written consent from Da’Villas.
Fees and Charges
Da’Villas reserves the right to levy additional reservation or facilitation fees at any time without prior notice to Guests.
User Terms
By using this website, you acknowledge that you accept all risks associated with the transaction and take full responsibility for any liability or harm related to any future activities concerning the accommodation involved in the transaction.
Promotional Offers
By submitting your contact details on the website, you consent to receive promotional content from Da’Villas via WhatsApp, email, push notifications, and SMS. Da’Villas may periodically offer discounts and promotions, which will be governed by the specific terms and conditions outlined on the website. These terms may change over time. Da’Villas also reserves the right to modify or discontinue any promotional offer at its discretion without prior notice.
Payment Options
Da’Villas accepts payments via credit/debit cards (Visa, MasterCard, RuPay, American Express) and net banking. Any bank or payment gateway fees are the guest's responsibility. If payment is not received, Da’Villas cannot process or fulfill the booking.
Payments Of Advances/Security Deposits By Guests and Damage to property
Guests must pay an advance to secure a booking before receiving confirmation. This advance safeguards Da’Villas against potential revenue loss from cancellations or unpaid balances. Without receiving the advance, Da’Villas will not issue the Booking Confirmation. Guests must inspect the property and report any damage to items within 90 minutes of Check-In. Failure to do so will hold the guest responsible for repair or replacement costs. Guests must handle the property and its items with care and leave them clean and in good condition, except for normal wear and tear, at Check-Out. If an item from a set is damaged and cannot be replaced individually, the guest must cover the cost of replacing the entire set. Guests must not move or relocate any equipment, furniture, or artifacts without Da’Villas' prior consent, except for movable items like chairs and plastic furniture. An inspection for damage will occur between guest departures and new arrivals. Security deposit refunds, minus any damage costs, will be processed within 30 days of Check-Out. Final repair or replacement costs will be communicated to guests. If repair or replacement costs exceed the security deposit, Da’Villas will notify guests in writing, and guests must pay the excess within 7 days. Refunds will be issued by cheque or bank transfer based on the provided account details or payment method used.
Financial Details
You confirm that your credit/debit card details are accurate and valid, and that any card used is lawfully owned by you. Da’Villas is not responsible for credit/debit card fraud; you are liable for fraudulent use, and the burden of proof lies with you.
Check-In and Check-out Timing
Check-In and Check-Out times are detailed in the Booking Confirmation. Early arrivals may incur an extra charge, and late Check-Outs could also result in additional fees. Any changes to Check-Out times will be confirmed in writing by Da’Villas.

Liability Constraints
Da’Villas acts solely as a booking platform and is not liable for the following:
a) Accidents, injuries, or deaths at the Property, including those resulting from fights or emergencies involving Guests, caretakers, or third parties.
b) Consequences of illegal or hazardous activities conducted by Guests or their companions.
c) Criminal acts, discrimination, harassment, or disruptive behavior by Guests or their companions.
d) Structural damages or issues with the Property, including paintwork, electronic devices, or pool maintenance.
Guests must report any damages before Check Out; Da’Villas will not address claims made after Check Out. Da’Villas’ liability for any damage to Guests or their companions is limited to the Booking Amount paid and will be determined solely by Da’Villas.
Safety and Restrictions
a. Guests must respect the neighbors’ peace and maintain tranquility, as the property is residential.
b. The property is for accommodation only, not for other uses.
c. Guests must avoid causing any nuisance to neighboring properties.
d. No loud music or disturbances are allowed in outdoor areas to prevent bothering neighbors.
e. The property must not be used for illegal or immoral activities; Da’Villas is not responsible for such actions.
f. Prohibited drugs and rave parties are strictly forbidden; violations will result in a police complaint.
g. Guests must not use prohibited drugs or host rave parties at the property. Violations will lead to a police report filed by Da’Villas.
Private and Confidential Data
Any information we collect will be kept confidential according to our Privacy Policy and applicable laws, including:
i. The Information Technology Act, 2000 (as amended);
ii. The Information Technology (Intermediary Guidelines) Rules, 2011 (as amended);
iii. The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (as amended).
Confidentiality applies to information provided through both our Online and Offline Booking
Channels.
Intellectual Property Rights
Unless specified otherwise, all software, content, and intellectual property related to our Online Booking Channels are owned exclusively by Da’Villas. This includes, but is not limited to, trademarks, logos, and proprietary information. You may not copy, link to, publish, or use our content or brand in any way. Any unauthorized use will be considered a serious violation of our intellectual property rights. If you do use or combine our content, you automatically transfer all related intellectual property rights to www.davillas.in. Any unauthorized use or actions mentioned will be considered a serious violation of our intellectual property rights.
Guests Issues
Guests acknowledge that Da’Villas makes reasonable efforts to provide accurate property descriptions and images. If amenities or conditions differ from what is depicted, Da’Villas is not liable. Guests must report any issues with amenities or cleanliness within 12 hours of Check-In, providing evidence. Da’Villas will attempt to resolve issues but is not liable for unresolved problems or refunds. Any issues must not be caused by the Guest’s actions. If the Property is unavailable at Check-In, Da’Villas will try to find a comparable alternative.
Termination
You understand and agree that Da’Villas reserves the right to terminate your registration and / or terminate your right to use this website for any reason whatsoever, including without limitation, any act or omission in contravention of the Privacy Policy or of these Terms and Conditions of Use. You further understand and agree that any such termination may be effected without prior notice to you and you acknowledge and agree that Da’Villas may delete or deactivate your account immediately on detecting any such reason, including without limitation, the contravention of the Privacy Policy or of these Terms and Conditions of Use.
Force Majeure
Da’Villas is not liable for any loss or damage arising from Force Majeure Events during the Booking or related to the website or reservations. Force Majeure includes events beyond Da’Villas’s control, such as strikes, natural disasters, war, civil unrest, and other unforeseen events.
Assignment
Any Bookings made by the Guests are not assignable.
Conflict Resolution and Governing Law
Any disputes or claims related to the Booking will be resolved through arbitration by a mutually appointed sole arbitrator, whose decision will be final and binding. The arbitration will take place in Mumbai, governed by the Indian Arbitration and Conciliation Act, 1996, and conducted in English. The competent courts in Mumbai will have jurisdiction over any matters not covered by the arbitration provisions.
Notices
Da’Villas will send notices to Guests in writing via email (to the provided address) or by posting on the Site or Application. For email notices, receipt is considered to be the date the email is sent.
Waiver
The failure of Da’Villas to exercise or enforce any right or provision of the Terms and Conditions mentioned on this website will not constitute a waiver of such right or provision.
Indemnification
By booking, you confirm it is for personal use only, not for commercial purposes. You agree to indemnify Da’Villas against any loss or damage resulting from a breach of this assurance, including loss of profits, indirect or consequential losses, property damage, and reputational harm.
Guests agree to indemnify and hold Da’Villas and its affiliates, contractors, and employees harmless from any claims, losses, or expenses, including legal fees, arising from their use or misuse of services, violations of the Terms and Conditions, or breaches of their

We may use this material for any purpose without compensating you. You also agree not to submit anything that infringes on third-party rights and acknowledge that you are responsible for any damages caused by your submissions, releasing Da’Villas from any liability.
